1.3 We’re committed to making your Crafty8 experience the best it can be, and for that, we might need to change these terms and conditions from time to time. We will alert you of any changes by updating the “last updated” date of these Terms of Service, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Service to stay informed of updates. Your continued use of the Site represents that you have accepted such changes.

2. The Crafty8 Promise

2.1 When you shop with us, you’re getting a promise that the goods you purchase will be:

• 2.1.4 Assembled and/or installed correctly (if we’re doing the assembly/installation).

2.2 You have the right to goods that comply with your legal rights, and we will always respect that.

2.3 We strive to make sure all descriptions on our website are accurate. We ask for your understanding if there is a small variance of up to 10% in any weights, sizes, and measurements of our goods.

2.4 While we try to display the colours of our goods accurately, the colours you see on your screen may vary slightly due to different monitors, software, and browsers. We can’t take responsibility for any variations caused by your equipment, but we promise our products are even better in person.

3. Our Liability

3.1 When it comes to our mutual trust, if a mistake from either of us results in a loss, we won’t hold each other accountable for any losses that couldn’t have been anticipated when the contract was formed, with Clause 3.3 as the exception.

3.3 These terms don’t intend to limit our or your liability in any way for:

3.3.1 Deaths or personal injuries caused by our negligence;
3.3.2 Fraud or fraudulent misrepresentation;
3.3.3 Any matter it would be illegal for you or us to exclude or attempt to exclude our or your liability.

4. Order Process

4.1 Your orders are always valued. Any order you place on this website will be accepted in accordance with these terms and conditions.

4.2 We feel a sense of accomplishment when your order is accepted and the contract between us is complete. This happens when you’re informed of your successful order and provided with your order number. Expect an order confirmation email from us shortly afterward.

5. Delivery

5.1 Our commitment to you is to make every effort to deliver goods within estimated timescales. However, please bear with us as we cannot guarantee a specific arrival date.

5.2 For custom orders, we understand the anticipation that comes with waiting for your goods. We’ll reach out to inform you when we expect to deliver your goods. For all other goods, we promise to contact you if, in the rare event, we cannot deliver within fifteen (15) working days of accepting your order.

5.3 There can be occasional delays due to unforeseen circumstances beyond our control. In such instances, we appreciate your understanding, as we cannot be held responsible for these delays.

5.4 If your goods arrive damaged, please get in touch with us as soon as possible. We value your trust and will arrange for the return and replacement of these faulty goods.

6. Unforeseen Events

6.1 We understand that life is unpredictable. We won’t hold each other accountable if, due to unforeseen events beyond our control, we fail to meet our obligations under the contract. These events can range from war and national emergencies to fires, floods, pandemics, labor disputes, transportation delays, or even natural disasters.

6.2 If these events occur, we’ll go the extra mile to fulfill our obligations as soon as we can. If your order hasn’t been delivered within six (6) weeks of the estimated delivery date due to an event beyond our control, you can contact us to receive a full refund.

7. Price and Payment

7.1 We strive to be transparent. The price of any goods will be as quoted at the time we receive your order, except in cases of clear errors.

7.2 You can pay for an order via any method specified on this website.

7.3 Please note that all cardholders are subject to validation checks and authorization by the card issuer. If the issuer refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

8. Availability

8.1 All goods are subject to availability. If there’s any delay, we’ll inform you as soon as reasonably possible.

8.2 In case we are unable to supply the goods, we will let you know as soon as possible and provide a full refund if you have already paid for the goods.

9. Right to Cancel, Returns, Refunds, and Exchanges

9.1 If the goods are faulty, you may cancel your order up to fourteen (14) days after you received them. We’re more than happy to offer you an exchange or refund, as long as the goods are returned complete, in original condition, and in their original packaging.

9.2 If you’ve opened any boxes to examine the goods, please ensure it was done without damaging the packaging in any way, as the packaging is considered part of the goods. We reserve the right to reasonably refuse any returns if the packaging is damaged and the goods are not in a resalable condition.

10. Intellectual Property Rights

All intellectual property rights, including goods, trademarks, trade names, logos, designs, and other materials, are our exclusive property. You shall not reproduce, modify, transfer, grant, assign, license or use the Intellectual Property, except in accordance with these terms and conditions.

11. Waiver

No failure or delay by a party to exercise any right or remedy shall constitute a waiver of that or any other right or remedy. Our commitment to these terms remains steadfast, regardless of the circumstances.

12. Flexibility

12.1 We believe in the fairness and solidity of our terms and conditions. However, should any part of this agreement be deemed unenforceable or unlawful by a competent authority, that part shall not affect the remainder of this agreement, which will continue to hold strong.

12.2 If such a situation arises, we will promptly notify you and adapt the term in question, ensuring its legality and enforceability while striving to preserve its original intent.

13. Upholding Illinois and Federal Law

13.1 Our operations, as well as transactions made through our website, are firmly rooted in the fertile grounds of Illinois law, without reference to conflict of laws principles. Our commitment to this state’s legal framework is unshakeable.

13.2 At the same time, we acknowledge and respect the comprehensive strength of U.S. federal law. These terms and conditions, your visit to our site, and any purchase contracts are governed by both Illinois state law and U.S. federal law.
